Privacy notice
How The SEND Practice looks after your information.
Draft. This privacy notice is being finalised and will be updated before The SEND Practice begins taking clients. Details marked “to be confirmed” will be completed then.
Who we are
The SEND Practice is an independent SEND consultancy and specialist assessment service. For the purposes of UK data protection law, The SEND Practice is the data controller for the personal information described here. ICO registration number: to be confirmed. Contact: to be confirmed.
What information we collect
When you make an enquiry, we collect the details you enter in the contact form: your name, email address, your child’s age, the main area of concern, any needs or diagnoses you choose to mention briefly, whether your child has an EHCP, whether there are attendance concerns, what you would like help with and your preferred service. We deliberately keep this to a minimum and ask you not to include names, medical details or reports at this stage.
If you become a client, we will collect further information needed to provide the service you have asked for. This may include information about your child’s education, special educational needs, health and wellbeing, and copies of documents you choose to share with us.
Special category information
Information about a child’s special educational needs, disabilities and health is special category data under UK GDPR. We only collect it where it is needed to provide the service you have requested, we keep it secure, and we do not share it without your consent unless the law requires us to.
Why we use your information, and our lawful basis
- To reply to your enquiry and arrange appointments (legitimate interests, and steps taken at your request before entering into a contract).
- To provide the services you have booked (performance of a contract).
- To process special category information needed to provide those services (your explicit consent).
- To keep financial and business records (legal obligation).
Who we share it with
We do not sell your information or use it for marketing. We do not contact your child’s school or other professionals without your agreement. We use a small number of trusted service providers to run the website, receive enquiries and manage bookings and payments. They process information only on our instructions. Details of these providers: to be confirmed.
Safeguarding
If we become concerned that a child is at risk of significant harm, we may need to share information with the appropriate authorities without consent, in line with safeguarding law and guidance.
How long we keep it
Enquiries that do not lead to work are deleted after a short period. Client records are kept only as long as necessary for the service and for legal, insurance and professional requirements. Retention periods: to be confirmed.
Your rights
You have the right to ask for a copy of your information, to have it corrected or deleted, to restrict or object to its use, and to withdraw consent at any time. To make a request, contact us using the details above. If you are unhappy with how we have handled your information, you can complain to the Information Commissioner’s Office at ico.org.uk.
